Daniel Penny trial: 3 pieces of evidence jurors asked to see again during deliberations

Daniel Penny faces protesters as he departs Manhattan Criminal Court | Watch

I have a couple of quick points to make. According to what I've seen, Neely had at least 42 arrests some of which included trying to kidnap a child and assaulting an elderly woman. There was a warrant out for his arrest on the day that he died. You can say that he was having a mental health crisis and I'd agree. That doesn't make him harmless, however.

NYC, and Alvin Bragg, have made it clear that they don't want people defending themselves from criminals in their city. This is especially true for White people but others know that the DA's office will wrap a defense case up in a racial bow if at all possible. The Botega owner that killed his attacker would probably agree.

Somehow, Neely was behaving badly enough that a White guy, a Black man and a Latino male all decided to try to restrain him on that fateful day. Bear in mind that witnesses have said that Neely brought a smell of "Soiled" sweatpants with him when he entered that subway car.

Sooooo.... three men decided to restrain a possibly violent nut that smelled like piss, shit and ballsweat? Do you know how bad a situation would have to be for the average male to choose to roll around on a subway car floor with a dirty mentally ill man that smells of "Soiled" sweatpants in a city that targets those that defend themselves?

Something seems off to me. Generally, when multiple people are involved in a crime then all of them are charged. If a teller is murdered during a bank robbery then the killer, the guy guarding the door and even the get away driver are charged with murder.

In this instance, the Black guy that helped with the restraint wasn't charged. The Latino that helped restrain Neely wasn't charged and oddly enough only the White guy is facing jail time. It's almost like the DA's office went out of their way to prove what I wrote earlier about race.

BTW, if the MSM could have found anything harmful in Penny's past then they would have done so. He apparently has no criminal record, had a good record in the Marines and has never posted anything controversial online. No one has come forward with tales of abuse, racism or vigilantism. He wasn't roaming the streets of NYC like Batman. He seems like a normal guy that just stepped up during a bad situation.

On the other hand, we have the guy that tried to kidnap a child, assaulted people and scared the subway car passengers so badly that some feared for their safety.

Your mileage may vary.
